مقدمة اتفاقية الاستخدام

Introduction to the Terms of Use

يرحب بكم متجر نسمات الشرق الإلكتروني. توضح هذه الاتفاقية الشروط والأحكام المنظمة لاستخدام المتجر والخدمات والمنتجات المقدمة من خلاله، والآثار القانونية المترتبة على ذلك. ويُعد استخدام المتجر أو التسجيل فيه موافقة على الشروط والأحكام الواردة في هذه الاتفاقية، وفق الأنظمة المعمول بها في المملكة العربية السعودية.

Welcome to Nasamat Alsharq Online Store. This agreement outlines the terms and conditions governing the use of our store, products, and services, as well as the associated legal implications. By accessing, using, or registering with our store, users agree to these terms and conditions in accordance with the applicable laws and regulations of Saudi Arabia.

المادة الأولى: المقدمة والتعريفات

Article 1: Introduction & Definitions

يُعد التمهيد أعلاه جزءًا لا يتجزأ من هذه الاتفاقية، ويُقصد بالمصطلحات التالية المعاني الموضحة أمام كل منها:

1. المتجر: متجر نسمات الشرق، ويشمل موقعه الإلكتروني وأي تطبيق أو وسيلة إلكترونية تابعة له، وكذلك المحل التجاري عند الاقتضاء.
2. المستهلك: كل شخص يتعامل مع المتجر للحصول على المنتجات أو الخدمات المتاحة من خلاله.
3. الاتفاقية: شروط وأحكام الاستخدام التي تنظم العلاقة بين المتجر والمستهلك.

The introduction above forms an integral part of this agreement. The following terms shall have the meanings set out below:

1. Store: Nasamat Alsharq, including its website, any affiliated electronic applications or channels, and its physical retail location where applicable.
2. Consumer: Any person who interacts with the store to purchase products or obtain available services.
3. Agreement: These terms and conditions governing the relationship between the store and the consumer.

المادة الثانية: أهلية المستهلك القانونية

Article 2: Legal Eligibility

1. يقر المستهلك بتمتعه بالأهلية القانونية اللازمة للتعامل مع المتجر، أو أن عمره لا يقل عن ثمانية عشر عامًا.
2. يتحمل المستهلك المسؤولية المترتبة على تقديم بيانات غير صحيحة تتعلق بأهليته القانونية، وفق الأنظمة المعمول بها.
3. The consumer confirms that they have the legal capacity to transact with the store or are at least 18 years of age.
4. Consumers are responsible, in accordance with applicable laws, for providing inaccurate information regarding their legal eligibility.

المادة الثالثة: طبيعة التزامات المتجر

Article 3: Store Obligations

1. يلتزم المتجر بتوفير المنتجات والخدمات المعروضة للعملاء وفق البيانات والشروط المعلنة.
2. قد يوفر المتجر خدمات إضافية، مثل خدمات ما بعد البيع وغيرها من الخدمات المرتبطة بالمنتجات، وفق طبيعة الخدمة أو المنتج المطلوب.
3. The store is committed to providing the products and services offered to customers in accordance with the published information and terms.
4. The store may provide additional services, including after-sales support and other services related to the products, depending on the nature of the purchased product or service.

المادة الرابعة: ضوابط استخدام المتجر

Article 4: Store Usage Guidelines

1. يلتزم المستهلك باستخدام الموقع الإلكتروني والخدمات التابعة للمتجر بما يتوافق مع الآداب العامة والأنظمة المعمول بها في المملكة العربية السعودية.
2. يلتزم المستهلك بعدم استخدام المنتجات أو الخدمات المشتراة من المتجر في أي نشاط يخالف الأنظمة واللوائح المعمول بها.
3. Consumers must use the store's website and related services in compliance with public standards of conduct and applicable Saudi Arabian laws and regulations.
4. Consumers must not use products or services purchased from the store for any activity that violates applicable laws or regulations.

المادة الخامسة: الحسابات والتزامات التسجيل

Article 5: Accounts & Registration Obligations

عند التسجيل في المتجر وإنشاء حساب، يلتزم المستهلك بتقديم بيانات صحيحة ومحدثة، والمحافظة على سرية معلومات الدخول الخاصة به، وفق الأحكام التالية:

1. يتحمل المستهلك مسؤولية المحافظة على سرية معلومات حسابه وكلمة المرور، وإبلاغ المتجر عند اكتشاف أي استخدام غير مصرح به.
2. لا يتحمل المتجر المسؤولية عن الخسائر الناتجة عن إفصاح المستهلك عن بيانات الدخول الخاصة به، وذلك في حدود ما تسمح به الأنظمة المعمول بها.
3. يلتزم المستهلك باستخدام حسابه بصورة شخصية، ويتحمل مسؤولية الاستخدام الذي يتم بتفويض منه.
4. يلتزم المستهلك باستخدام المتجر بجدية ومصداقية.
5. يلتزم المستهلك بتقديم معلومات صحيحة وكاملة ومحدثة أثناء التسجيل، وتحديثها عند حدوث أي تغيير.
6. يلتزم المتجر بالمحافظة على سرية المعلومات الشخصية وبيانات التواصل الخاصة بالمستهلك وفق الأنظمة المعمول بها.
7. يحق للمتجر اتخاذ الإجراءات المناسبة، بما فيها تعليق الحساب أو إلغاؤه، في حال تقديم معلومات مضللة أو مخالفة لشروط الاتفاقية، وفق الأنظمة المعمول بها.
8. يحق لإدارة المتجر تقييد الوصول إلى خدماته أو إيقاف الحساب عند مخالفة شروط الاستخدام، مع مراعاة الحقوق النظامية للمستهلك.

When registering and creating an account, consumers must provide accurate and up-to-date information and maintain the confidentiality of their login credentials, subject to the following conditions:

1. Consumers are responsible for protecting their account credentials and passwords and must notify the store of any unauthorized use.
2. The store shall not be responsible for losses resulting from a consumer's disclosure of their login credentials, to the extent permitted by applicable laws.
3. Consumers must use their accounts personally and are responsible for any use they authorize.
4. Consumers must use the store honestly and responsibly.
5. Consumers must provide accurate, complete, and current registration information and update it when necessary.
6. The store is committed to protecting the confidentiality of consumers' personal information and contact details in accordance with applicable laws.
7. The store may take appropriate action, including suspending or terminating accounts, where misleading information is provided or the agreement is violated, subject to applicable laws.
8. Store management may restrict access to services or suspend accounts when the terms of use are violated, without prejudice to consumers' legal rights.

المادة السادسة: الاتصالات الإلكترونية ووسائل التواصل الرسمية

Article 6: Electronic Communications & Official Contact Channels

1. يوافق أطراف الاتفاقية على إمكانية التواصل من خلال البريد الإلكتروني المسجل في المتجر.
2. يوافق المستهلك على استخدام الوسائل الإلكترونية لتبادل الاتفاقيات والإشعارات والبيانات المتعلقة بالتعاملات مع المتجر، وذلك وفق الأنظمة المعمول بها.
3. يجوز للمتجر إرسال الإشعارات المتعلقة بالطلبات أو الحسابات أو تحديثات الاتفاقية عبر وسائل التواصل المعتمدة، مع مراعاة المتطلبات النظامية المتعلقة بالرسائل التسويقية وحماية البيانات الشخصية.
4. The parties agree that communications may take place through the email address registered with the store.
5. Consumers agree to the electronic exchange of agreements, notices, and transaction-related information in accordance with applicable laws.
6. The store may send order updates, account notifications, and agreement-related notices through its official communication channels, subject to applicable requirements regarding marketing communications and personal data protection.

المادة السابعة: تعديل اتفاقية الاستخدام والرسوم

Article 7: Amendments to Terms & Fees

1. في حال اعتبار أي بند من بنود الاتفاقية غير نافذ، فلا يؤثر ذلك في استمرار نفاذ بقية البنود، وفق الأنظمة المعمول بها.
2. يجوز للمتجر تحديث اتفاقية الاستخدام عند الحاجة، مع مراعاة الالتزامات والحقوق المقررة نظامًا.
3. قد تترتب رسوم أو ضرائب على بعض المنتجات أو الخدمات وفق الأسعار المعلنة والأنظمة المعمول بها.
4. يحتفظ المتجر بحقه في تعديل الرسوم والأسعار والعروض وفق الإجراءات النظامية، دون الإخلال بالحقوق الناشئة عن الطلبات والعقود القائمة.
5. If any provision of this agreement is deemed unenforceable, the remaining provisions shall continue to apply in accordance with applicable laws.
6. The store may update these terms of use when necessary, subject to statutory rights and obligations.
7. Certain products or services may be subject to applicable charges or taxes in accordance with published prices and relevant regulations.
8. The store reserves the right to modify fees, prices, and promotional offers in accordance with applicable laws, without affecting rights arising from existing orders or contracts.

المادة الثامنة: خدمات الدفع والسداد

Article 8: Payment Services

1. يوفر المتجر وسائل دفع إلكترونية من خلال مزودي خدمات الدفع المتاحين في الموقع، وقد تتغير خيارات الدفع من وقت لآخر.
2. يلتزم المتجر بعرض أسعار المنتجات والخدمات وفق الأنظمة المعمول بها.
3. يلتزم المتجر بتوفير الفواتير والمستندات المتعلقة بعمليات الشراء وفق المتطلبات النظامية.
4. يلتزم المتجر بتطبيق المتطلبات المحاسبية والمالية والضريبية المعمول بها في المملكة العربية السعودية.
5. The store offers electronic payment options through the payment service providers available on its website. Available payment methods may change from time to time.
6. The store is committed to displaying product and service prices in accordance with applicable regulations.
7. The store will provide purchase invoices and relevant transaction documents as required by law.
8. The store shall comply with applicable accounting, financial, and tax requirements in Saudi Arabia.

المادة التاسعة: الملكية الفكرية

Article 9: Intellectual Property Rights

1. يحتفظ متجر نسمات الشرق بحقوق الملكية الفكرية الخاصة به، بما يشمل العلامات التجارية والشعارات والتصاميم والمحتوى المملوك له، وفق الأنظمة المعمول بها.
2. يلتزم المستهلك باحترام حقوق الملكية الفكرية الخاصة بالمتجر والحقوق المملوكة لأطراف أخرى، ولا يجوز استخدام المحتوى أو الشعارات المحمية دون الحصول على التصريح اللازم من صاحب الحق.
3. Nasamat Alsharq retains its intellectual property rights, including its trademarks, logos, designs, and owned content, in accordance with applicable laws.
4. Consumers must respect the intellectual property rights of the store and third parties. Protected content or logos may not be used without the necessary authorization from the respective rights holder.

المادة العاشرة: مسؤولية المتجر

Article 10: Store Liability

1. يلتزم متجر نسمات الشرق بممارسة نشاطه التجاري وفق الأنظمة واللوائح المعمول بها في المملكة العربية السعودية.
2. لا يتحمل المتجر المسؤولية عن الأضرار أو الخسائر الناتجة عن أخطاء المستهلك أو الأطراف الخارجية، بما فيها شركات الشحن، إلا في الحالات التي تترتب فيها مسؤولية على المتجر بموجب الأنظمة المعمول بها.
3. يلتزم متجر نسمات الشرق ومنسوبوه ومُلّاكه وممثلوه بتقديم منتجات وخدمات نظامية ومصرح بها، وفق المتطلبات المعمول بها في المملكة العربية السعودية.
4. Nasamat Alsharq is committed to conducting its commercial activities in compliance with the applicable laws and regulations of Saudi Arabia.
5. The store shall not be liable for damages or losses resulting from consumer errors or third-party actions, including shipping carriers, except where liability is imposed on the store by applicable law.
6. Nasamat Alsharq, its personnel, owners, and representatives are committed to providing lawful and authorized products and services in accordance with Saudi Arabian regulations.

المادة الحادية عشرة: تقييد الوصول أو العضوية

Article 11: Account Restrictions & Suspension

يحق للمتجر تعليق أو إلغاء عضوية المستهلك أو تقييد وصوله إلى خدمات الموقع عند مخالفة شروط الاستخدام أو الأنظمة المعمول بها، مع مراعاة حقوق المستهلك النظامية.

The store reserves the right to suspend or terminate consumer accounts or restrict access to its services when the terms of use or applicable laws are violated, without prejudice to the consumer's statutory rights.

المادة الثانية عشرة: النظام الواجب التطبيق

Article 12: Governing Law

تخضع اتفاقية الاستخدام هذه لأنظمة المملكة العربية السعودية ولوائحها المعمول بها، وتُفسر أحكامها وفق الأنظمة ذات الصلة.

This agreement shall be governed by and interpreted in accordance with the applicable laws and regulations of the Kingdom of Saudi Arabia.

المادة الثالثة عشرة: أحكام عامة

Article 13: General Provisions

تُعد هذه الاتفاقية إطارًا لتنظيم العلاقة بين المتجر والمستهلك، وتُطبق وفق الأنظمة المعمول بها في المملكة العربية السعودية، مع مراعاة الأحكام التالية:

1. تُعد اللغة العربية المرجع الأساسي لتفسير أحكام الاتفاقية عند وجود اختلاف بين النسختين العربية والإنجليزية، مع مراعاة الأنظمة المعمول بها.
2. قد تتغير أسعار المنتجات والخدمات المعروضة في المتجر من وقت لآخر، دون المساس بالحقوق الناشئة عن الطلبات المؤكدة.
3. العروض التسويقية والترويجية مؤقتة، ويجوز تعديلها أو إيقافها وفق الشروط المعلنة والأنظمة المعمول بها.
4. يلتزم الطرفان بالتعامل وفق الأنظمة والتشريعات المعمول بها في المملكة العربية السعودية.
5. يجوز لإدارة المتجر تعديل الاتفاقية أو إيقاف العمل بها وفق الأنظمة المعمول بها، دون الإخلال بالالتزامات والحقوق القائمة.

This agreement establishes the framework governing the relationship between the store and the consumer and applies in accordance with Saudi Arabian laws and regulations, subject to the following provisions:

1. The Arabic version shall serve as the primary reference for interpreting this agreement in the event of discrepancies between the Arabic and English versions, subject to applicable laws.
2. Product and service prices may change from time to time without affecting rights arising from confirmed orders.
3. Promotional and marketing offers are temporary and may be modified or discontinued in accordance with published conditions and applicable laws.
4. Both parties agree to conduct their transactions in compliance with applicable Saudi Arabian laws and regulations.
5. Store management may amend or discontinue this agreement in accordance with applicable laws, without prejudice to existing obligations and rights.
